Sentencing for Konolus Smith, the Meyers man convicted in December of spousal battery and making criminal threats, was delayed Monday.

El Dorado Superior Court Judge Suzanne Kingsbury rescheduled sentencing for Feb. 4.

Smith's attorney, Jordan Morgenstern, plans to submit a motion to the court this week. He declined to comment on the nature of the motion.

Smith stood trial in December and also faced charges of attempted murder and false imprisonment.

A mistrial was declared on those charges because of a juror's misconduct.

Smith's wife had accused her husband of tying her up in the early-morning hours of Aug. 29 and threatening to stab her with a pair of scissors if she didn't swallow a combination of pills.
